BOOKING TERMS AND CONDITIONS - SHINE STRONG PSYCHOLOGY (SSP)


TAKE TIME FOR WELLBEING RETREAT


Please read these terms and conditions carefully. When you make a booking, you accept the terms of these booking conditions. It is your responsibility to ensure that all of the details on your confirmation documents are correct and to bring to our attention any errors or discrepancies within 48 hours of your booking.


BOOKINGS AND QUOTES


Bookings can be made over the internet at www.shinestrongpsychology.com.au or by calling Shine Strong Psychology on 0404 414 699. Reservations are subject to availability and actual pricing at the time of booking. You agree to pay the rate for days of the retreat.


PAYMENT POLICY


A deposit of $60AUD must be received to secure the booking. Bookings are not confirmed unless and until the deposit is received. Payment in full must be received no later than 6 weeks prior to the retreat, Thursday 26th August 2021. Payments of the amount due must be received in AUS dollars net of any bank or other transaction charges. Please ensure payments are made within the specified time limits or the booking will be cancelled automatically without notice.


PAYMENT OPTIONS


Payments are accepted by credit cards, Visa, MasterCard or AMEX. Credit card or payments can be accepted via direct deposit.


CANCELLATION TERMS & CHARGES


If you wish to vary or cancel your booking, please contact us immediately on 0404 414 699. Your deposit is non-refundable in the event of a cancellation. If you have paid more than the deposit or paid in full and cancel your booking 6 weeks prior to the retreat date then you will be refunded all moneys less $60 tariff deposit. If you cancel within 6 weeks of departure no refund will apply. Should you be eligible for a refund it will be made through your chosen account.


NOT INCLUDED IN PRICE OF WELLBEING RETREAT


Any airfares, transfers, overnight accommodation, dinner on Thursday night. No drinks other than what is provided for morning tea and lunch. Optional extras that are not included in the itinerary.


MINORS


This retreat is not for anyone under the age of 18 years of age.


TRAVEL INSURANCE


We strongly recommend you purchase comprehensive travel insurance at time of booking. We suggest that the policy should include, but not be limited to, the reimbursement of any monies paid in the event the travel is cancelled, loss or damage to personal baggage and loss of money and medical expenses.


HEALTH AND FITNESS

 

A good level of fitness and health is required to participate in the wellness retreat. On Fitzroy Island mobility is needed to board the transfer vessel and navigate coral beaches. It is your responsibility to advise SSP of any pre-existing medical conditions, health and mobility related concerns that may affect the normal conduct of the retreat and the enjoyment of other participants.


FORCE MAJEURE


Force Majeure means the occurrence of an event that is beyond SSP reasonable control and which could not have been reasonably prevented by SSP, which includes, but is not limited to: (a) war, armed conflict, criminal damage, riot, civil strife, industrial dispute, terrorist activity or the threat of any such acts; (b) natural disaster (including but not limited to flooding, fire, earthquake, landslide), adverse weather conditions, high or low water levels; (c) nuclear or other industrial accident causing environmental pollution or contamination; or (d) change in law, meaning, enactment, amendment (including repeal) in the law or administration of any law in Australia or any jurisdiction or territory relevant to the booking contract, which includes changes in statute, regulation, determination, by-law, declaration, licence and the common law as applicable from time to time, including changes or amendments in regulations or access to services, sites or countries caused by declared epidemic or pandemic events.


TERMINATION OF BOOKING CONTRACT OR CHANGE OF TRAVEL ARRANGEMENTS DUE TO FORCE MAJEURE


If SSP, in its reasonable opinion, considers that any Force Majeure event prevents SSP (whether directly or through its employees, contractors, subcontractors) from lawfully or safely providing any products or services subject of the booking contract with you, SSP may immediately by written notice: (a) terminate the booking contract (in whole or in part); or (b) change the retreat dates as reasonably practicable to ensure your safety.


LIMITATION OF LIABILITY IN THE EVENT OF FORCE MAJEURE


In the event of a force majeure event making it impossible or unsafe for SSP to deliver all or part of the retreat, SSP will refund the client for the unperformed part of the retreat less any reasonable losses incurred before cancellation. Losses may amount to a substantial proportion of the booking price. SSP will use reasonable endeavours to minimise losses incurred by clients. Clients must take out travel insurance to protect themselves against loss in the circumstances.


COVID-19 CANCELLATION CONDITIONS


SSP acknowledges the risk of a wave of this specific pandemic and in the incidence that this occurs and the retreat is unable to go ahead will refund full amounts to all participants. Please check Fitzroy Islands cancellation policy for transfers, accommodation and meals.


LIMITATION OF LIABILITY


Our retreat includes the services of independent providers, such as hoteliers, boat transferees, and other operators, who are not agents, servants or employees of SSP. Although we take care in selecting the independent service providers and the optional excursions conducted by some independent service providers, SSP is not responsible for the conduct of the independent service providers, their servants and agents or for any ramifications of that conduct. Optional excursions may, depending on your retreat, include activities such as, exploring, swimming and snorkelling. You accept and assume the risk involved with these activities.


If, in the opinion of any representative of SSP, your mental or physical condition, or general behaviour is such as to affect your own health and safety, render you incapable to care for yourself, cause you to became a hazard to yourself or other passengers or result in you becoming objectionable to other passengers or staff, you will not be permitted to embark or continue on the whole or any part of the retreat. Abuse or harassment of any kind toward crew, contracted suppliers or other guests may result in immediate removal from the retreat. SSP is not liable to you for any costs associated with such decision and you will not be refunded for any part of the retreat package.


SSP accepts no responsibility for any death, injury, illness, loss (including loss of enjoyment), damage, detention, delay (including mechanical breakdown) beyond its control.


Any term, condition or warranty express or implied by statute or otherwise in respect of the retreat contained on this website are excluded to the full extent permitted by law. Nothing in these booking conditions excludes, restricts or modifies the application of the Competition and Consumer Act 2010 (Cth) as amended, consolidated, supplemented or replaced.


To the full extent permitted by law, SSP’s liability arising under or in connection with these booking conditions: (a) is limited to the re-supply of the products or services or the payment of the cost of re-supply of the products or services to you; and (b) excludes liability for any indirect or consequential losses suffered by you or any third party, howsoever caused, including but not limited to pure economic loss or any special, extraordinary or punitive damage to you or any other party.
